UPTE (University Professional and Technical Employees) was created by fellow UC
employees to give us all a voice in the University system. UPTE is a democratic
organization run by staff members like your-self, and its issues are the ones articulated by
the technical and professional workers at the University of California campuses across the
state.

Under the state labor law known as HEERA (Higher Education Employer Employee
Relations Act), Sec. 3565, employees are guaranteed the rights to join, and participate in
an employee organization, and under Sec. 3571(a), it is unlawful for an employer to impose
or threaten to impose reprisals, or otherwise restrain or coerce employees who exercise
their rights guaranteed under HEERA.
KNOW YOUR RIGHTS!

State and Federal Law have determined that public employees, including employees of the
University of California are entitled to dues process and representation rights.

SKELLY RIGHT: California Supreme Court ruled that UC employees are entitled to
"pre-disciplinary hearings". Employees must be given a written notice of the proposed
disciplinary action, including a statement of the proposed discipline, the effective dates of
the proposed discipline, the reasons for the discipline, the specific policy or rule violated,
and statement advising the employee of their right to respond orally or in writing.

WEINGARTEN RIGHT: The Supreme Court ruled that employees are entitled to have a
union representative present when supervisors ask for information that might be used as a
basis for discipline. Management has no obligation to tell employees of this right, so
employees MUST ask for union representation before the meeting. It is also recommended
that the request be put in writing and that the employee keep a copy
.

Here’s a brief check list of what’s involved in getting reclassified. Contact UPTE for more information and

•        Rewrite your job description.
•        Obtain a copy of your original job duties.
•        Obtain a copy of the “Series concept” for your job from campus Human Resources or on the webs at

•        Write out your job duties in detail on the Job Description form.  Compare your current duties to
match those described in your series; request other job-class series concepts for comparison;         
ask others with same job title to share their job card description.
•        Prepare an organizational chart. (Many departments already have one made up.)
•        Complete Reclassification Request Form or write a cover letter requesting reclassification.
•        Send information to Human Resources (858-534-0281)
